Getting ready for Court

If you have been charged with a criminal offence, going to Court can be a nerve-racking experience.

However, there are some things you can do before you get to the Courtroom which will help you and improve your chances of a good result.

What should I wear to Court?

What you wear to Court can make a big impression on how the Magistrate or Judge perceives you.

So it’s important to dress in clothes that let people know you are taking them seriously.

Ensure that you have neat, tidy hair. Men should be cleanly shaven and beards trimmed.

The best clothes to wear are a collared long sleeve shirt with a tie. If you have a good suit, and the weather is appropriate, wear the suit.

The biggest mistake people make is wearing clothes that are old and/or do not fit.

It’s better to wear good quality pants, a shirt and tie, than an ill-fitting suit.

The colour of the clothing is also important. DO NOT WEAR BLACK! It is amazing how many people wear black clothes when attending Court. It gives the impression of a night thief and should be avoided.

What should I bring to Court?

Do not take any sharp implements or weapons to the Court complex. Most court complexes have security screening, much like at the airport, for weapons and other prohibited articles. Remember to check your pockets before leaving home, as if you are found with any of these objects you may be charged with further offences.

If there is a chance you may be sentenced to a custodial sentence, ensure you leave all your valuables at home and have $100 cash on your person.

Be Respectful

If you are sitting in the Courtroom waiting for your matter to be heard, be quiet and respectful. The Magistrate or Judge will be observing you even when they are dealing with other matters, and how you behave at the back of the Courtroom may cause them to take a negative attitude towards you even before they deal with your matter. Please ensure your mobile phone is turned off and sit in silence until your lawyer calls your matter.

When your lawyer calls your matter there will usually be a chair for you to sit in behind them. In most cases, they should ensure that you are seated before beginning to deal with your matter. When your lawyer is speaking, always remain silent and calm. Again, you are being observed by the person who is just about to penalise you.

After your lawyer has finished speaking, they will ask you to stand up. The Magistrate or Judge is about to hand down the penalty. Stand straight up and look at the Magistrate or Judge when they are speaking to you. It is important they know you are listening and that you understand what they are saying. If you do not agree with something, do not answer back. It is never in your interests to answer directly to the Magistrate or Judge unless they ask you a question directly. If there is a problem, or you think they may have got something wrong, tap your lawyer on the shoulder to ensure they are aware. Chances are they are aware and will address the issue when the Magistrate or Judge has finished speaking.
