Driving while disqualified
It is an offence under Section 25A(1) of the Road Transport (Driver Licensing) Act 1998 to drive while your licence is disqualified.
Driving while disqualified penalties NSW
If you are caught driving whilst your licence is disqualified the maximum penalty is 30 penalty units ($3,300.00) and/or 18 months imprisonment for a first offence. The automatic disqualification period is 12 months.
The penalty increases to 50 penalty units ($5,500.00) and/or 2 years imprisonment or both for a second offence. The automatic disqualification period is 2 years.
Driving while suspended or cancelled
It is an offence under Section 25A(2) and 25A(3) of the Road Transport (Driver Licensing) Act 1998 to drive while your licence is suspended.
Your licence may be suspended for a number of reasons, such as accumulation of demerit points or failing to pay your fines.
The Police have sophisticated software which allows them to identify drivers whose licence has been suspended.

If your licence is suspended due to your inability to pay the fines, a court must take into account the effect the penalty or period of disqualification will have on your employment and the person’s ability to pay the outstanding fine that caused the person’s driver licence to be suspended or cancelled.
That is why is it important that the Court be provided with an accurate description of your current financial circumstances, which is usually best done by engaging a legal representative to make submissions on your behalf.
